Three individuals accused in connection with the murder of a popular restaurateur in Owen Sound, Ontario, have agreed to be extradited from Scotland to face trial in Canada. Robert Evans, aged 25, is charged with manslaughter, while his father, Robert Busby Evans, aged 47, and his uncle Barry Evans, aged 54, are facing charges as accessories after the fact.
The extradition process is expected to proceed swiftly, according to Robert Currie, a transnational criminal law expert at Dalhousie University. The formalities and terms of the extradition agreement between Canada and the UK are being finalized, with the transfer likely to occur in a matter of days or weeks, as it is an uncontested extradition process.
The trio appeared in Edinburgh Sheriff Court and expressed their willingness to be extradited to Canada to answer the criminal charges against them. Initially, there were indications that the defendants might contest extradition, citing concerns about the conditions in Ontario jails violating their human rights.
Sharif Rahman, the owner of The Curry House, tragically passed away in August 2023 after an altercation outside his restaurant in Owen Sound. The accused individuals acknowledged their irrevocable consent to extradition and will remain in Scottish custody until they are sent to Canada for trial. The Canadian authorities have assured that any time spent in custody in Scotland awaiting extradition will be considered in their sentencing if found guilty.
The extradition process involves legal procedures between Canada and the UK, and it is not uncommon for individuals to agree to extradition without contesting it. The reasons behind the accused individuals’ consent to extradition in this case remain undisclosed. Upon their arrival in Canada, they will be treated like any other defendants awaiting trial, with access to assistance from their respective embassies or consulates.
While details about the accused individuals were initially limited, an investigation by CBC News revealed their identities through social media profiles. Robert Evans Jr. is accused of throwing the fatal punch, while Barry Evans and Robert Busby Evans are alleged to have assisted in the aftermath of the incident.
The court did not specify an extradition date for the accused individuals, and the legal proceedings are expected to continue as they prepare to face trial in Canada.
