Customers of a British Columbia (B.C.) currency exchange specializing in transactions between Canada and Iran have taken legal action and lodged complaints alleging owed sums amounting to tens of thousands of dollars. The Coquitlam Royal Canadian Mounted Police (RCMP) have confirmed an ongoing investigation into the claims made against VanEx Currency Exchange.

A group of eight individuals has initiated small claims lawsuits against the establishment in recent times, while additional clients asserting larger outstanding balances voiced their grievances directly to the company’s leader in a recent meeting. President Pouria Emadi stated to CBC News that VanEx is actively collaborating with the RCMP and has devised plans to settle all outstanding debts by July. Emadi attributed the delay in repayments to operational challenges arising from internal disputes among the company’s founders and external disturbances in Iran.

One affected customer, Sharereh Momeni, expressed her distress over potentially losing $7,600 earned through months of hard work at a campground in Clearwater, B.C. Momeni, who had borrowed funds in Tehran to immigrate to Canada, lamented her predicament, having placed her trust in the legally registered Canadian company.

The situation at VanEx stems from a legal battle in the B.C. Supreme Court involving the company’s co-founders, who established the business in 2019 to facilitate money transfers between Iran and Canada amidst U.S. sanctions. Unsatisfied clients have also escalated their concerns to the provincial financial watchdog, awaiting action under a forthcoming law designed to regulate B.C.’s money services sector.

VanEx’s growth over the years has been substantial, with revenues exceeding $1.7 million in 2023. However, internal discord led to a standstill within the company, prompting Emadi to seek court intervention for a sale resolution. Despite the prolonged legal dispute between the co-founders, debts began accumulating externally, affecting customers like Masoud Ghorbani, who is pursuing repayment of a significant sum transferred from Iran.

The company’s failure to address outstanding debts has sparked dissatisfaction among customers like Pouya Taatizadeh, who emphasized the importance of fulfilling promises made during their transactions. VanEx has faced multiple lawsuits demanding refunds, with the company contesting certain claims and proposing repayment schedules due to financial constraints.

In response to customer complaints and legal actions, Emadi assured that VanEx is committed to stabilizing its operations and gradually repaying owed amounts to customers. However, the delayed regulatory framework in B.C. has drawn criticism from affected parties, who feel unsupported by the authorities in resolving financial disputes related to the currency exchange.

The lack of immediate regulatory oversight has left customers in a challenging position, with ongoing efforts to establish effective regulations in the money services industry. The Ministry of Finance emphasized the need to implement the new Money Services Businesses Act cautiously to ensure proper governance of financial transactions. While avenues for seeking recourse exist, including legal action and reporting to relevant authorities, the slow progress in regulatory implementation has left impacted individuals feeling abandoned amidst financial uncertainties.
