“Former Ontario Teacher Gets 5+ Years for 1980s Sexual Assaults”

A former elementary school teacher in Burlington and Hamilton, Barbara Baxter, aged 88, has been sentenced to more than five years in prison for sexually assaulting seven male students during the 1980s. The guilty verdict on seven counts of sexual assault and acts of gross indecency was delivered by a jury in February. The sentencing decision was announced by Justice Kendra Coats at an Ontario Superior Court of Justice hearing in Milton on Jan. 13.

The case came to light when a man reported being sexually abused at Pineland Public School in Burlington in the early 1980s when he was in Grade 8. This initial report to law enforcement in June 2022 led to further revelations. Subsequently, another man reported similar abuse, and three additional men came forward with accounts of incidents between 1983 and 1987 at the school and at Baxter’s residence in Burlington.

The former students’ identities are protected under a publication ban. During the sentencing, victim impact statements were presented. One of the victims expressed feeling unsafe both at school and home, resorting to drugs at the young age of 13 to cope. He described a sense of having his voice taken away by figures of authority, leading him to remain silent about the abuse.

Another victim mentioned enduring emotional distress over the decades, impacting his health with sleep disturbances and nightmares related to the traumatic events. The toll on his mental well-being was described as a form of “mental torture.” A third victim shared the long-lasting effects of Baxter’s abuse, including ongoing struggles with post-traumatic stress disorder, anxiety, depression, financial instability, and difficulties in forming relationships.

During the sentencing proceedings, Baxter’s defense highlighted her advanced age and the passage of time since the offenses were committed. The defense emphasized Baxter’s lack of prior criminal record, her family support system, and her health challenges, including rheumatoid arthritis and diabetes. The defense argued that Baxter’s age and health conditions should be considered in determining an appropriate sentence.

The Crown, however, stressed the severe impact of sexual abuse on child victims, especially when perpetrated by someone in a position of trust like a teacher. The significant age gap between Baxter and the victims was underscored as exacerbating the misconduct. The Crown emphasized the need for denunciation and deterrence in sentencing to acknowledge the lasting harm caused by Baxter’s actions.

Before her tenure at the Halton District School Board, Baxter worked at the Hamilton-Wentworth District School Board (HWDSB) from 1961 to 1968. The case serves as a reminder of the enduring consequences of sexual abuse and the importance of seeking support for those affected.
