Jennifer Graves fulfilled a vow by attending the Nova Scotia Legislature on Tuesday. As a survivor of sexualized violence, she was present as legislation was reintroduced to prohibit the use of non-disclosure agreements (NDAs) to conceal violence, coercion, harassment, or discrimination. The bill, presented by the Liberal party, would apply retroactively, with an exception for survivors who signed NDAs voluntarily after seeking legal advice.
Graves, who faced sexualized violence at Dalhousie University, emphasized the importance of her ability to speak out. She stressed the urgent need for action, criticizing the government for allowing violence to persist and hindering survivors from coming forward.
The Progressive Conservatives have faced pressure to amend the law since taking office in 2021. Justice Minister Scott Armstrong acknowledged the misuse of NDAs to silence survivors and expressed his commitment to addressing the issue. However, Armstrong highlighted the importance of a nationwide approach and plans to discuss the matter with justice counterparts across the country before considering independent action.
In the interim, Armstrong advised survivors not to sign any documents without consulting legal counsel. Meanwhile, Interim Liberal Leader Iain Rankin suggested that the province could act independently while supporting a national effort. NDP Leader Claudia Chender urged swift action, emphasizing the negative impact of NDAs in perpetuating abuse and harassment.
Graves criticized the current support systems, stating that they fall short in assisting victims coerced into signing NDAs. The Liberals also introduced bills to provide paid leave for employees experiencing gender-based violence and to review the Victims Services system.
