“Probation Failures Exposed in Tragic Domestic Violence Case”

A probation officer manager rated Basil Borutski’s compliance as “Target met: 95% – 100%” just two days after Borutski killed his ex-partners Anastasia Kuzyk, Nathalie Warmerdam, and Carol Culleton in September 2015. Borutski, a repeat domestic violence offender, had been under probation supervision for nearly three years in Renfrew and Pembroke, Ontario, following his jail time for abusing Kuzyk and Warmerdam.

Despite being tasked with ensuring Borutski adhered to court orders and collaborating with partner agencies for the victims’ safety, multiple opportunities for intervention were reportedly overlooked by the probation officers. This failure was highlighted in a subsequent death review conducted by probation and parole managers from a different region.

Following the tragic murders, the local manager’s main concern was the lack of monthly contact with Kuzyk, despite the “target met” score being the highest achievable. Expressing disbelief, Malcolm, one of Warmerdam’s sons, and lawyer Kirsten Mercer, who represented victim advocacy groups, criticized the probation system’s response to the escalating risks posed by Borutski.

Management reviews conducted prior to the killings in 2013 and 2014 revealed missed opportunities to address Borutski’s non-compliance with court orders related to domestic violence programming. Despite warnings and indicators of Borutski’s high risk and manipulative behavior, the probation officers did not effectively address these concerns.

The disclosure of Borutski’s probation records shed light on the systemic failures within the probation system that might have prevented the tragic outcome. While some improvements have been made since the inquest, challenges persist in effectively managing high-risk offenders and protecting victims of intimate partner violence.

Moving forward, advocates like Mercer and Malcolm Warmerdam emphasize the need for continuous improvement and proactive measures to prevent similar tragedies in the future. They urge collective action to bridge the gap between knowledge and action in combating domestic violence effectively.
