“Farmers Call for Tax Law Update to Save Family Farms”

A provision within the Income Tax Act, designed to sustain family-owned farms, is under scrutiny by some farmers in southern Ontario who argue that the legislation is outdated given the current agricultural landscape.

Under the existing law, when a farm changes hands, the new owner must report it as a capital gain and include it in their income tax payment. This requirement, particularly burdensome when ownership transitions within the same family, has a significant financial impact, as highlighted by Steve Cooper, a Uxbridge-based cattle farmer.

Cooper emphasized the substantial tax implications, noting the challenge for younger farmers to come up with the necessary funds to sustain existing farm operations. While the Income Tax Act allows for a deferral of capital gains tax for children inheriting family farms, this benefit does not extend to nieces and nephews inheriting such properties, prompting calls for a broader application of the deferral criteria.

Advocates, including Cooper and other farmers nationwide, are urging the federal government to amend the law to encompass nieces and nephews in the deferral provision, citing the evolving nature of farm succession beyond immediate family members.

Statistics from a 2024 report by the National Farmers Union reveal a decline of 23% in the number of farms, with approximately 57,000 farms ceasing operations or merging between 2001 and 2021, underscoring the urgent need for policy adjustments to support the agricultural sector.

Derryn Shrosbree, a vegetable farmer from Mount Forest, has been a vocal proponent of the proposed amendment, asserting that modifying the law could prevent the closure of thousands of farms annually. He stressed the impact of the tax burden on new farm owners, particularly nieces and nephews inheriting family farms, in a changing agricultural landscape where fewer individuals are pursuing farming as a career.

Moreover, escalating costs for farmers in Canada, exacerbated by recent global conflicts leading to price hikes for essential supplies like fertilizer and diesel, are further straining the industry’s financial viability, according to Shrosbree.

While there are existing programs, such as the Lifetime Capital Gains Exemption, aimed at alleviating tax obligations for farm owners, uncertainties persist regarding potential revisions to the Income Tax Act. Government officials have indicated a commitment to periodically reviewing tax regulations for fairness but refrained from commenting on specific legislative changes.

Looking ahead, Cooper, who operates a diverse farm in Uxbridge, anticipates potential tax challenges for his family farm in the coming years. With succession planning underway, Cooper’s nephew, a prospective successor, faces the prospect of a substantial tax bill upon inheriting the farm due to existing limitations in the tax law.

The push for amending the Income Tax Act to accommodate nieces and nephews inheriting family farms reflects a broader effort to ensure the sustainable transfer of agricultural assets across generations, safeguarding the continuity of farming operations in Canada. Shrosbree remains optimistic about the future, advocating for policy reforms that support the longevity of family-owned farms and rural communities, essential components of Canada’s agricultural heritage.
