Jack Smith, the former special counsel who brought charges against U.S. President Donald Trump in two cases that never went to trial, criticized “inaccurate and deceptive narratives” during his initial public testimony to Congress about his investigation.
Smith was assigned by the U.S. Justice Department to lead two existing inquiries into Trump after he announced his presidential candidacy in 2024. Despite this significant role, the former prosecutor had made limited public statements prior to Thursday’s testimony.
“President Trump faced charges because the evidence indicated that he intentionally violated the laws he swore to uphold,” Smith stated before the House judiciary committee.
“If presented with the same facts today, I would pursue charges against a former president, regardless of their political affiliation.”
Smith and his team eventually charged Trump with plotting to overturn the 2020 election he lost to Joe Biden and retaining classified materials, including top-secret documents, at his Florida residence into 2023.
In response, Trump has publicly criticized Smith, labeling him a “Radical left Marxist prosecutor” and a “sick son of a b****” at a White House event on Tuesday.
Recently, Trump and the White House presented an alternative version of the Jan. 6, 2021, Capitol riot, following weeks of objections to the election results.
“Our analysis of the evidence points to him being primarily responsible for the events of Jan. 6,” Smith responded to questions from Democratic Rep. Eric Swalwell of California, who blasted Republican lawmakers for attempting to tarnish the former special counsel.
Republicans Ready to Testify: Smith
Smith is under investigation by the Office of Special Counsel, much like other officials who have crossed paths with Trump during his second term, such as former FBI director James Comey and New York State Attorney General Letitia James.
Trump called for Smith’s prosecution, alleging “widespread perjury” without substantiating the claim, based on Smith’s testimony.
During his testimony, Smith expressed belief that the Justice Department under Trump will seek to charge him.
